We at Sociall.ly, (“Sociall.ly,” “we,” “us,” or “our”) have established this privacy policy (this “Privacy Policy”) because we know that you care that information you share with us is collected in the right manner, stored, and utilized for your benefit. This Privacy Policy relates to the collection and use of your personal information by Sociall.ly in connection with our Platform and Services, as defined below.

SERVICES

This Privacy Policy applies to Sociall.ly-branded apps, communications and services (“Services”) on loganwilson.ca. We are an online platform leased to real estate professionals to connect them with individuals seeking real estate services (the “Platform”). People use our Services to find and be found by real estate professionals for information and assistance with purchasing and selling properties. Our Privacy Policy applies to any member or visitor using our Platform.

DATA CONTROLLER

Sociall.ly will be the controller of Personal Information provided to, or collected by or for, or processed in connection with our Services, regardless of the location of users accessing and using our Platform.

CONSENT AND CHANGES TO POLICY

By using our Platform, you are agreeing to the terms of this Privacy Policy. When you provide us with Personal Information (as defined below) through our Platform, you will be prompted to provide your consent to Sociall.ly’s collection, use, disclosure, and retention of your information in accordance with this Privacy Policy and as otherwise permitted by law.  You are not required to provide your personal information online; our Platform and Services are provided as a convenience. Where we rely on your consent to process Personal Information, you have the right to withdraw or decline your consent at any time by (i) e-mailing us at [email protected], (ii) calling us at 1-250-661-8915, or (iii) following the instructions found on the Platform.

This Privacy Policy is effective as of the date stated above. Sociall.ly reserves the right to modify this Privacy Policy from time-to-time and without notice, therefore, please review our statement periodically. We will provide notice to you of material changes to this Privacy Policy by posting such changes on our Platform, emailing you or by prompting you via popup.  Your continued use of the Platform and our Services following any such modification constitutes your agreement to follow and be bound by the updated Privacy Policy. This Privacy Policy is not exhaustive. In particular, if you use our Platform, the data that you submit as you use our Platform will be further governed by applicable Canadian laws.

INFORMATION WE COLLECT

1. PERSONAL INFORMATION

When you sign up to become a registered client user of our Services, or if you request information or indicate that you would like to be contacted by a real estate professional, you will be asked to provide us with personally-identifying about yourself (“Personal Information”).  Personal Information may include your name, address, phone number, e-mail address and any additional information about yourself that you voluntarily provide, such as Facebook data, gender, birthdate, interests, etc. 

We do not collect any Personal Information from you when you use our website or Platform unless you provide us with the Personal Information voluntarily (for example, by registering to use the Platform, completing an information form, or joining our e-mail list). You may provide us with personally identifiable information when you complete a survey; make a purchase; request customer support; subscribe to certain services, email notifications and/or newsletters; register for our Platform, complete an information form or register and/or set up an account/profile to access, visit and/or use certain portions of websites hosting our Platform; provide comments, reviews, feedback, or testimonials about our Platform; and any other transactions between you and us in relation to our Platform.

2. COLLECTION AND USE OF OTHER INFORMATION

In addition to the Personal Information, Sociall.ly collects non-personally-identifying information (“Other Information”). Such Other Information may include:

  • Your Device and Location

Information that we automatically collect when you use the Platform, such as the device from which you access the Platform, your IP addresses, geolocational data, browser type and language, referring and exit pages and URLs, date and time, amount of time spent on particular pages, what sections of the Platform you visit, and similar information concerning your use of the Platform.

  • Cookies, Web Beacons and Similar Technology

Information that we collect using “cookie” technology. Cookies are small packets of data that a website stores on your computer’s hard drive so that your computer will “remember” information about your visit. We use cookies to help us collect Other Information and to enhance your experience using the Platform. If you do not want the Platform to place a cookie on your hard drive, you may be able to turn that feature off on your computer or mobile device. Please consult your Internet browser’s documentation for information on how to do this. However, if you decide not to accept cookies from us, the Platform may not function properly. When the Platform is made available to you through Facebook and/or other third-party sites, please be aware that these other sites maintain their own policies regarding cookies and the collection and use of information. You are responsible for reviewing those policies.

  • Sites and Services of Others

Information that we collect or receive from Facebook and/or other sites on which you have used the Platform in accordance with their terms of use and privacy policies and applicable law.

  • Third-Party Advertisers

We share Other Information about your activity on the Platform with third parties for the purpose of tailoring, analyzing, managing, reporting, and optimizing advertising you see on the Platform and elsewhere. These third parties may use cookies, pixel tags (also called web beacons or clear gifs), and/or other technologies to collect such Other Information for such purposes. Pixel tags enable us, and these third-party advertisers, to recognize a browser’s cookie when a browser visits the site on which the pixel tag is located in order to learn which advertisement brings a user to a given site. By using the Platform or the website, you consent to this collection.

  • Third-Party Analytics

We use third-party analytics services (such as Google Analytics) to evaluate your use of the Platform, compile reports on activity, collect demographic data, analyze performance metrics, and collect and evaluate other information relating to the Platform and mobile and Internet usage. These third parties use cookies and other technologies to help analyze and provide us the data. By accessing and using the Platform, you consent to the processing of data about you by these analytics providers in the manner and for the purposes set out in this Privacy Policy. The information used by such analytics services is generally at the aggregate level. ACCESSING AND MODIFYING PERSONAL INFORMATION AND COMMUNICATION PREFERENCES

If you have registered for the Platform, you may access, review, and make changes to your Personal Information and certain Other Information by (i) e-mailing us at [email protected], (ii) calling us at 1-250-661-8915, or (iii) following the instructions found on the Platform. In addition, you may manage your receipt of marketing and non-transactional communications by clicking on the “unsubscribe” link located on the bottom of any Sociall.ly marketing email. Users cannot opt out of receiving transactional e-mails related to their account unless they end their services. We will use commercially reasonable efforts to process such requests in a timely manner. You should be aware, however, that it is not always possible to completely remove or modify information in our subscription databases. In such case, we will provide you the reason why the modification or removal was not possible.

HOW WE USE YOUR DATA

1. Our Services

Our Platform is leased and integrated into third party websites in order to facilitate and generate leads for real estate professionals. We use yourPersonal Information’ and Other Information to provide lead-generating services to our clients and to provide you with access to and the ability use of the Platform.  In order to achieve this, we use your Personal Information and Other Information as described below.

  • We will disclose certain Personal Information, including your name, phone number and e-mail to the companies and real estate professionals hosting our Platform and Services on their website so that they may contact you to provide you with information about the products and services they offer.
  • Unless you opt-out of receiving such messages from us, including security and legal notices, we may use your Personal Information to contact you about service-related issues, security, promotions our business or other relevant news.
  • We may disclose Personal Information or Other Information collected from you to our independent contractors and business partners who have agreed to (i) hold this information in confidence and (ii) not use it for any purpose except to carry out the services they are providing for Sociall.ly. Such contractors and business partners include those hosting our Services or other data; managing the functionality of our Services; hosting client relationship management, marketing automation, customer service and other software platforms on our behalf; processing credit or other payment card payments; collecting delinquent accounts; fulfilling and processing orders; delivering platforms; conducting background checks if you submit an application for employment; assisting with marketing and promotions; and enabling us to send you email.
  • In an ongoing effort to better understand our users and improve our Platform, we may analyze the Other Information, including geolocational information in aggregate form in order to operate, maintain, manage, and improve the Platform. This aggregate information does not identify you personally. We may share this aggregate data with our affiliates, agents, and business partners. We may also disclose aggregated user statistics in order to describe our products and services to current and prospective business partners and to other third parties for other lawful purposes. Use of the app affirms that statistics will be collected.
  • We may employ other companies and individuals to perform functions on our behalf. Examples may include providing marketing assistance, plan fulfillment, billing, and customer service. These other companies will have access to the Personal Information and the Other Information only as necessary to perform their functions and to the extent permitted by law.
  • As we develop our businesses, we might sell or buy businesses or assets. In the event of a corporate sale, merger, reorganization, sale of assets, dissolution, or similar event, the Personal Information and Other Information may be part of the transferred assets.
  • To the extent permitted by law, we may also disclose Personal Information and the Other Information when required by law, court order, or other government or law enforcement authority or regulatory agency, or whenever we believe that disclosing such information is necessary or advisable, for example, to protect the rights, property, or safety of Sociall.ly or others.

 

HOW WE PROTECT YOUR INFORMATION

We take commercially reasonable steps to protect the Personal Information and the Other Information from loss, misuse, and unauthorized access, disclosure, alteration, or destruction. Please understand, however, that no security system is impenetrable. We cannot guarantee the security of our databases, nor can we guarantee that the information you supply will not be intercepted while being transmitted to and from us over the Internet. In particular, e-mail sent to or from the Platform may not be secure, and you should therefore take special care in deciding what information you send to us via e-mail.

We take reasonable measures to require that the party receiving any of your Personal Information undertakes to: (i) retain and use such information only for the purposes set out in this Privacy Policy; (ii) not disclose your Personal Information except with your consent, as permitted by law, or as permitted by this ‘Privacy Policy; and (iii) generally protect the privacy of your Personal Information.

IMPORTANT NOTICE TO NON–CANADIAN RESIDENTS

Our Platform is leased from and operated in Canada. If you are located outside of Canada, please be aware that any information you provide to us will be transferred to and stored in Canada, which may have laws which are different and potentially not as protective as the laws of other countries. We will take reasonable measures to require that the party receiving any of your Personal Information undertakes to: (i) retain and use such information only for the purposes set out in this Privacy Policy; (ii) not disclose your Personal Information except with your consent, as permitted by law, or as permitted by this Privacy Policy; and (iii) generally protect the privacy of your Personal Information. By using the Platform or the Services and/or providing us with any information, you consent to this transfer.
